Landlord dragging their feet

My husband moved to Colorado for a job offer and he found a apartment to live in. He signed a year lease with every intention of both of us living there after he settled and I was able to close things up here in my home state. After 4 months his job fell through and he decided to move back to his home state. He gave the landlord a months notice and he thought he found someone to take over his lease (and yes he talked to landlord about that) but that fell through too. My husband moved back home and we have been paying rent on this apartment since April without him living there. Everytime we email and ask if the apartment is rented the landlords wife is RUDE! I talked to a friend in the community and they noted that someone moved in on July 31,2012. And we had already sent August rent. We waited until August 20th to email to see if they were going to admit to someone moving in. And their response was, there was someone interested in your unit and then they backed out because they realized that we did not allow pets. We had to refund their rent and deposit all within a few days time, he moved in one day and out the next. (which is a lie since my "friend" in the community said he was there for less then a week, but not one day and gone the next) If you would like to have your friends check they are more then welcome. My question is…is this my husband problem? How can they let someone move in then back out and still hold my husband responiable for the rent. He still has Sept.-Dec. to pay rent can we file complaint and get this to stop. And I don’t feel they are even trying to mitigate damages.
