I think my landlord is trying to rip me off

My boyfriend and I rent a store that we need to sublease.  The landlord was fine with this as long as we found new tenants, and they pass a credit check.  Our lease also states that these are the only requirements to be met.  We found a new tenant, they passed the credit check, and have money for the security deposit.  Good, everything is done, we just need to go sign some papers.  SO, when we go to the office, I start reading the the sublet contract, and it says we will have $250.00 taken out of our original security deposit to pay for the lawyer’s fee for writing the document.  I told him that he never said anything about this- he replies "you didn’t ask".   When I got home, I looked over our lease again, and there is no mention of a fee for subletting.  IS THIS LEAGAL?

I would suggest reading over your lease agreement with a fine tooth comb. It may not disclose the fee in the agreement, but equally important it probably doesn’t exclude the fee either. Most likely somewhere in the agreement you will be able to find something that says both parties may be responsible for attorney fees concerning the agreement or changes to it.
As for your question of whether or not your landlord is legally charging the fee… Well, the fee seems to be well within the bounds of the law. I can assure you that no state will specifically have a law that prohibits a fee for re-assignment of a lease.

Yes it’s legal. You are the one breaking the lease not them.
