Can Landlord Evict Me Over Complaints?

I rented a house as of 4/01/2011. I sent letter dated 4/28/2011 w/May rent check to landlord advising of issues found w/house and expressed my displeasure over having to clean up dead roaches/droppings from upper kitchen cabinets. Paid a $300 ‘non-refundable fee’ in lieu of deposit.
Landlord called me on 5/02/2011 and advised I and my 2 children have to move immediately. Then landlord sent letter to me via UPS telling me I need to move. Landlord stated in letter, "as discussed, given your complaints regarding this house, I think it is best that you move. The purpose of this letter is to demand that you vacate the premises." "Please vacate…within 15 days of this corespondence…"
I replied to him via fax that I will not vacate as I have a signed lease and that neither my informing him of issues nor expressing my displeasure constitute ground for him to summarily terminate my lease.
Is this a retalitory act by the landlord? I am NOT being told to leave due to non-payment of rent, violating terms of lease or any other reason.

Try to check your lease agreement. Repairs/Damage section. I understand this must have an inconvenience for you but some lease agreement states that an owner/landlord or even a tenant can terminate the lease if such premise is deemed to be inhabitable due to the damages and other issues underlying the condition of the premise. It would be best to try to reach out to your landlord and talk about the lease agreement in that way it can be squared out and since leases may vary too. Another option also is to file a complaint through the RPA site and let the agent take care of it or just report the landlord and create a record for it. |
