Can I sue my Landord for tresspassing and invasion of privacy
By Steven Oliveira
I broke my lease two month early and I used civil code 1942. There were many issues with the apartment. The major issues were trash, rats in the walls, safety hazards around the property. I did everything in writing and when the problems were not fixed I sent a final letter giving the date I was leaving and again referenced civil code 1942. The final straw came when the landlord allowed the property maintenance man and a Sears technician into my apartment without my consent; lease clearly states that they have to give me 48 hours notice. I included that in the final letter, since I have a dog in the apartment (which I paid for with a deposit and an added $25 pet rent fee) and was extremely upset because someone could have been bitten or my dog could have gotten out. I paid my January rent and noted on the check it would be my last payment and again referenced civil code 1942. Yesterday I receive a letter from the property that they want almost $5000 by the end of February for unpaid rent and late fees and everything else they could charge me including filling nail holes. I know the apartment has been rented and the new tenants are moving in February 5th. What can I do? Should I sue them for entering my apartment? Can I sue for harassment? What options do I have?
