Can I sue, how to go about?

My daugther’s ceiling came crashing down this morning while we were sleeping, and the debri and dust hit her in her bed along with fell straight to the ground.  It sounded like the building collapsed.  She and I are asthmatic and have bad allergies and the dust is burning our throats and eyes.  I told the super it was a emergency to come that the ceiling just fell in and he came up and said that he will be back in 1 hr, if I can move my stuff out of the room so he can knock down the rest of the ceiling for repair.  He said he will clean up today and put the ceiling up and do the repair tomorrow morning.  My question is can I sue if the stuff hit my child in her bed? Also are they required to fix today since it happened in the morning why should I wait unitl the next morning?  Are they supposed to put me and my family up in a hotel while the repairs are being done? What are my options, and should I be calling any agency’s?

Yes, you can sue your landlord. But that can take time and money. If you are looking to find a fast solution why not just file a formal complaint with the RPA? I had an attorney that told me I should first do that before suing my landlord over another unrelated problem. I never had to use the attorney.

I agree… there are other options you should choose before suing your landlord. If there is a some sort of neglect then maybe; but even then I would probably try other options first.

Anyone can sue anyone. But it doesn’t mean you should.

I live in a rental that had a water leak too. I think my renters insurance covered my belongings and the property itself was covered by my landlords policy.

Yep, renters insurance should cover your things. If you don’t have it you might be screwed. I see that all the time where people don’t get renters insurance and try to get their landlord to cover the cost of replacing their stuff.
