Broken Lease Due to Foreclosure
By Mibrau
Hi,
I rent a single family home in Milwaukee, Wi. We were just given notice by our landlord on Jan 11th 2013 that on Feb 4th 2013 she has the motion hearing for the property to be foreclosed. If it does get foreclosed then we will have 90 days to vacate the premises. As you can guess we recieved word on Feb 4th that the house has been foreclosed. I am trying to get some information on if we should be still paying rent to her? Our lease was signed July 12th for an August 1st move in date, The small claims court was filed on Aug 28th. It is my understanding that she knew about the forclosure before we signed the lease. Does that make our lease void? This is the first property I have rented so I have no idea where my next move should be. To me it seems that she should not have had us sign a year long lease when she had prior knowledge of her possibly losing the house. When she called me on Jan 11th she basically made it seem she already knew she was going to lose the house. Didn’t she have to get us notice of this before we signed the lease, or at least when the complaint was filed?
Here is a link to the court case, if you click on the top right hand corner where it says court events you can see the final outcome.

Thanks
