Break the lease based on lies and neglect
By anonymous
I moved into my apartment with my family which includes a young child about 4 months ago. Within a month of me moving in I found bedbugs. I told my landlord/management office of the situation and they sent out 2 exterminators within a week or so of each other. This did not seem to help and I saw bedbugs the next day. Anyway, I find out through investigation of Bedbugregistry.com that a person who posted there complained about bedbugs and lead and most likely is the same person who inhabited my apartment before me. This was also told to me by a neighbor and the description matches the post on the website. I called a state agency and complained about the bedbug situation and also complained of other issues within the apartment. I come to find out there is a presence of lead in my apartment as well. The management office/landlord did not disclose this to me through the real estate agency I hired to get this apartment. I received no form or verbal acknowledgement this existed and i know there is a Bed Bug Disclosure Act that states the landlord has to. They claim ignorance and "its a new thing". I signed a Lead Disclosure Form that stated that they have no knowledge of lead in the apartment. Now that is false because they received a complaint that is listed with the New York agency (311) and received violations for this same apartment. After much going back and forth over the phone they signed a lease to let me go . Is this valid even though I haven’t fullfilled the entire year? Some people are telling me that it wouldn’t be valid. Based upon the information provided is this legit for me to leave without incurring any backlash?
