Exterior noises

I rented a one bedroom apartment two years ago. There is a train track that is located about 50 feet from my apartment. I asked about it before I rented and the leasing agent said that the train didn’t run that often and the other tenants said they had gotten use to it. Well, two years later and I have never gotten use to it. I’m exhausted and the train runs about every two to three hours. Also, the unit is so close to the tracks that the entire apartment shakes when the train goes by, sometimes for up to 5 minutes. Several of my personal items fell and broke after I first moved in, but I learned to remove breakable items from shelves, etc. after that. I need out of this lease! Do I have any legal rights here?

Tenant rights is very important. I guess you could needed to inspect the apartment thorughly when you were renting the room. As you mentioned, trains frequency to pass from this tracks are every 2 to 3 hours, You could have also remained in house for that time when you were renting the apartment, so if train have came and you could have easily understood how and how much does the apartment shakes, or what you could have faced problems in future. However now as you have left the premises, if your belongings that broke were of importance or costly, then why not go ahead with some legal help. |

As a tenant it is very important that you have even just a little bit knowledge of your state laws and landlord-tenant laws. Were you able to do a thorough walkthrough of the apartment before you moved in? You know that as a tenant you have the right to quiet enjoyment and since you are not experiencing this then you can break your lease for landlord breach of contract. You need to serve your landlord with a written notice to vacate the rental unit first before you move out. |
