Bed Bugs in the apartment

Hello, my name is Natalia Buriak. I found a bedbugs in my apartment. I told the landlord about it, and she sent a terminator who confirmed that we have those. Also, the landlord said that we are responsible for the cost of the Bed Bugs Treatment, because this is our fault. But this is an old building, and we leave above the laundry room. We did not go anywhere, so we could not bring the bugs with us. Maybe, they came from the laundry room or from the neighborhood. The problem is that there is a clause in our Residential Lease that says: "We are not responsible for the infestation of bed bugs" (meaning the landlord). They told us that they will send their terminators to our apartment to treat the bed bugs, and it will cost us about $800. We do not have such money, and it can not be our fault. How can we prove that this is not our fault to split the amount of the treatment at least by half or make them pay for it? Or maybe we can do the treatment by ourselves or find cheaper terminators?

Please, help me, I am despaired.

Bed bugs in the apartment

Hello sir,

I was living in the studio apartment from last 12 months, now I had a newborn so I moved to one bedroom unit in to the same apartment building across the hall, As soon as I moved I found that there were plenty of bed bugs in the one bedroom apartment, bed bugs were all over my mattress, I informed the office people and they send some one to check it and now they are sending some one to do pest management, they want me to dry heat all the clothes and all other my stuff and my mattress is also now not usable.
The apartment I moved in to was locked for past 6 months, the tenant living in that before left the apartment without saying to any one, and then nothing was done in that apartment and when I moved in to that apartment I was the victim of all the bed bugs. Every one knows this bugs were left by previous tenant. now these people are offering me 1/3 of my rent off the next month’s rent and advising me to stay there. But these incident ruined my 1500$ worth of mattress, many of my clothes, I had to waste my 2 days to dry all clothes, My newborn was put at risk and so on…..

I want to know my legal options now. Can I sue them for all the harassment I have gone through? Can I break my lease for all these reason?

Hey, wow that was inconvenient. For this case yes the you can break the lease early because of the habitability issue though the landlord acted immediately about the issue. So if you are willing to break the lease and transfer to another apartment you may. Bed bugs are not controlled but can be eradicated anytime.
