security deposit
By samara
Moved out an apartment: was charged $145 for cleaning carpet and additional fees for oven cleaning all of which I have pictures. Also the complex management has no record of the $120 money order I gave for a portion of my deposit which it clearly states the full amount on the lease agreement.
The apartment I recently applied for denied my application due to unsatisfactory criminal history and refused to returned my deposit saying I have forfeit my deposit undisclosed information which they consider "falsifying information".
What are the steps and who do I sue for my security deposit?

I rented an apartment with 3 other people. They moved out one month before our lease was up. I paid my last month’s rent, none of the other 3 did. My landlord refuses to return the security deposit claiming unpaid rent. Doesn’t he have to return mine as I paid my last month’s rent? I live in SC.

We need waaaaay more information to answer this. Who did your landlord make the agreement with? Who put down the security deposit? Did the four of you roommates have an agreement? This is why you need stuff in writing. |

My former landlord has refused with my security deposit saying that my apt was infested with rouches. During my stay the apts changed ownership and both owners had tried to eradicate them in all apts in vain. She says my money was used in pestcontrol in my apt.
Can I sue her?

Ok I signed a one year lease with my current Landlord which DO NOT suppose to expire until 05/28/2011. Due to a gas leak in my home I am forced to move out. I have section 8 and the housing authority terminated the lease because they stated in writting(which I have) that my home is unsafe and unlivable. In this case …… Do my landlord still have 30 days to return my deposit?

My landlord has applied all my security deposit towards repairs. He claims that the apartment was damaged by us when in fact it was not. You will not believe he ahs even added charges for smoke detector, mailbox lock, replaced the carpet. For other appartment, teh company has charged 1295 for kitchen cab, replace knob, clean grease etc. Patch paint $1,438, replace carpet $ 3, 024.
After forefiting my security deposit has sent me a bill for $5,572.
All advise is appreciated.

The damage should be categorized as normal wear and tear. Well at least in most leases its stated that way. If it helps seek assistance from a person with legal background to help understand the lease a bit more. If you want to go to the next level there’s an option for you to report your landlord through RPA. |

My question is …. my former landlord stated that she was going to sell her property and she would help me find another place….. I however decided to not wait for her to find one… and found a place on my own( this conversation was on 9/2010)….9/15/10 I informed landlord that I am actively looking for a place. On 9/27/10 i informed landlord i found a place. on 10/4/10 i informed landlord i will be signing my new lease on this day…… I moved out of old home on that weekend and by 10/12/10 all my personal and physical effects were out and keys returned to her by10/20/10 no physical damage or any thing wrongwith townhouse…….My question is how long can a landlord hold a security deposit?
Thank you
