Security deposit return runaround

By ajjylrodarte

After finishing a year lease that ended 10/31/2011 and providing 60 days notice of moving as required, we were informed our deposit would take 30-45 days to be recieved from the corperate office. Still today we have not recieved anything as told would many times. Everytime I have called and asked about it they just get my information again and say will be our in about 5 business days. I couldn’t even get an answer about how much from our deposit we’re to get back. What is it that we can do about this? Any help appreciated. Thank you.

Check your state gov’t website for rental laws to see if there is a time limit for returning the security deposit. In my state of Pennsylvania, the landlord is required to refund the security deposit less any itemized damages 30 days after the lease ends as long as the keys & a forwarding address are provided. If not, then they can be sued for up to twice the amount of the security deposit.

Security Deposit Return Runaround

We gave notice and vacated property 6 days early and left it immaculate!  Which gave them opportunity to lease out immediately.  Our lease states upon vacating the landlord has 15 days to return deposit.   We vacated on 24th of August and we gave them until the 15th of September before we called to find out when the check had been returned.  The owner stated the funds were held by the realty agency.  The realtor agent was out of State on honeymoon in Columbia, no assistant called us back.  We called the HOA manager of our unit and was told her office had sent a check  to the agency.  We again called the agency and were told to wait until she got back from Columbia in 4 days. The agent called me and forwarded an e-mail from the HOA manager that the HOA manager did not know when the check had been sent to the agents company but it usually took 3 weeks.  The Agent then told me they would need to wait until there was transfer of the funds, confirmation before sending me my check in the mail.  It is now 18 days over due and still not answer as to when the check was sent to agency.  Can I file a complaint?  The HOA manager suggested that the realty company was unethical in their practises of holding money to cover their operating expenses.  If they are doing this to that many people, they should be turned in.  Where do I file and with whom do i file this type of complaint?
