Apartment complex refused to give me the apartment even after signing the lease in NJ
By anonymous
I am moving to New Jersey from Illinois and signed a lease with an apartment complex in NJ in the month of Nov 2011 to rent an apartment from Jan 2012. They told me that there is only 1 apartement that is available from Jan 2012. I signed a lease and gave all the deposit money (security deposit & advance rent). I also hired a mover in IL and moved my stuff and told them to deliver after Jan 09. I also took transfer certificate from my son’s school and based on the lease signed I asked them to send the reocrd to the school attached to my new NJ address. Just yesterday the apartement complex called me that the tanent who is living in the unit has revoked the "intent to vacate" notice and is not vacating the apartment. They told me that they can not let me rent this apartement and I have to look somewhere else as they have no other unit they can rent me.
I don’t know what to do now. The apartement management says that NJ tanent law gives all rights to the existing tanent to revoke the "intent to vacate" notice. My question is what are the rights for future tanent like me who moved the house to NJ based on the paperwork done with the apartment management. My son can not go to school because I have no lease to show in the school (I signed the lease but they didn’t give me the copy stating the reason that they will give the copy on the same day I get the pocession i.e. In Jan 2012). I have to pay extra to the movers to store my stuff until I get a new apartment to move in. I researched and found that all other apartments in that area are fully occupied and I can not get any apartment until Feb 2011. In this case my son can’t go to school for another 1 month because of this problem created by this apartment management. Can someone tell me what are my rights in this case.
Thanks
Sam
