Can management of leasing office do this?!

By Will

I have been renting at my complex for two years now. Have paid my rent on time every month and never had any issues with other tenants or against me until recently. The woman that moved in below me continuously makes FALSE noise complaints to the leasing office and has even gone as far as to call the police. On the occasion that she called the police I explained to the officers that I in fact had JUST gotten home from work (I bartend at various night clubs and lounges) and that I was home alone therefore her claim that I was arguing with someone and throwing things to the floor was completely untrue. The officers even came into my apartment to confirm that I was alone. On a different occasion the leasing office called me waking me up at 10am to ask if i was home because they received a complaint that I was throwing a ball around my apartment. Insulted, I told them I am grown and do not do such things and that I’m certain the complaint was coming from the lady below. I explained to them that it sounds like the carpet is being changed above me and that is what she is hearing. The manager put me on hold to check the maintenance schedule, as if she did not believe me, only to confirm what i said. I told her that this has gone too far and now I feel harassed by the tenant below as well as management for every time she makes a compliant they do not use appropriate protocol in investigating her claims but instead believe everything she says and immediately take action against me. She apologized and said she would make notes to the file as well as speak to the woman below. Well, recently I received a FIRST NOTICE on my door stating that management has received complaints (I’m sure from the woman below!) stating that I entertain at night which is not correct. Being that I am a bartender my work hours range from 5pm-5am therefore how the heck am I even home to entertain?! I have not once entertained since I have lived here. The only visitor i have is my mother who visits frequently from out of state. My mother has even had an issue with the woman below when she allowed her dog to growl, run and jump on my mother while she was in my doorway. Per these issues I have decided not to renew my lease which is now expired. As if this issue is not enough, recently a member of management gave my information to a third party while being questioned about an individual they knew I know however the individual does not live on the property therefore, I feel they should have left my name and information (apartment # and garage #) out of it. They also let the party onto the property to allowing them to access me. I do not feel safe and wish to move immediately however I am faced with giving notice or paying penalties. If my rights are in fact being violated can i move now without penalties? Also, how can I file a formal complaint? Should i seek legal representation? Thank you!!
