We moved out of our apartments in Oct. 09. We did a walk through at the end and both parties were happy. We got our security deposit back. The contacted me at the end of July 10′ and said oh hey you owe us this much money for carpet cleaning. They stated they didn’t know about it till now. Can they come after me for damages after we had received our security deposit return and 9 months later?

Hi Amber. Well, 9 months is a bit long for the landlord to realize for you to pay for the damages. And in fact it is in the moving out process that all the damages should be settled before the security money is given back to the tenant. So you really don’t need to worry about it.

Hi Amber. I just would like to emphasize what you said, that’s already over a 9 months ago, right?? That means they should have contacted you earlier than that. And then there is a move out inspection sheet. If he had dismissed you already, then that is as good as you don’t have any responsibility left to your landlord. If he insist on this then ask for any proof that those damages were done when you were still on the property.

Hello, my landlord evicted a neighbor, she was a half month behind, and was told she would be receiving a eviction 5 day notice from the police. Rather than going though all of the police and court process (costing more) she left willingly per the manager agreeing that she could, to not receive the 5 day notice, the court still granted the eviction, without giving her the notice she just received a letter in the mail about the eviction being granted. On Aug. 30th she did a walk though with the apartment manager whom wrote on her move out slip that the apartment was in very good condition and turned in the keys. The landlord used her security deposit for the remaining Aug’s rent. Now however she received a letter owing rent and late fee’s (knew the late fee’s would be there for the month of Aug.) even tho she was out prior to Sept., and left the apartment in immaculate condition. On to my question. Are they able to legally charge her for Sept.’s rent even though she was out prior to Sept. and was no longer in a lease? Hello to you too.. wow this is so confusing. Okay first since she was out of the lease and the landlord granted it to her then it was fine, she only have to pay for the time she stayed on the property and the owner already reduced the amount from the deposit so the landlord should have no reason to charge her of anything. why would she pay for september when she’s not staying there?
